Circumstances of Offense:
Robert had stopped by a dry-cleaning business when authorities say that Bernardo Tercero and Jorge Gonzales proceeded to rob it. During the robbery, Bernardo shot Robert to death and got away with $400 dollars. Warrants for capital murder and unlawful flight to avoid prosecution (UFAP) would be issued several months later. Bernardo would be arrested a few years later after trying to cross back into the United States. He was prosecuted for the crime where he claimed the shooting was self-defense. A jury convicted Bernardo and sentenced him to death. His execution was stayed in 2015 based on defense claims that a prosecution witness lied about Bernardo’s explanation for shooting Robert. It should be noted that Bernardo has never denied shooting Robert, only claiming it was an accident since both men were supposedly struggling for Bernardo’s gun. This is despite the fact that Bernardo committed the crime while in the commission of committing aggravated robbery and Robert was simply a customer. Jorge is believed to have fled to Mexico and is criminally liable for his alleged involvement in Robert’s murder under Texas law. As of this posting, Jorge has an active capital murder warrant in Harris County’s court records database and is not in custody. The UFAP warrant is still active according to PACER.
