Vital Statistics
Circumstances of Offense:
Throughout the night at the gathering, family members noticed a local man lurking, walking back and forth in front of the home. The man was known to the family but he was not welcome on the property and he knew it. Witnesses later stated that when Wayland left to walk home, the man walked off with him. The next morning, Wayland was found dead barely more than a block away from his aunt's home. He had been shot in the eye
Additional Details:
Approximately 6 months after Wayland was murdered, a grand jury indicted the lurker that left walking with Wayland for his murder. However, almost 3 years later on February 5, 2018, the Walker County District Attorney's Office filed a motion to dismiss the murder charge without prejudice. The motion stated the following: Newly reported DNA evidence from the victims body indicates that someone other than the Defendant had contact with the Victim at some time prior to his death. The State is in the processes of trying to identify who this new DNA comes from and is in the process of sampling all the first responders. DNA sampling and testing will be time consuming. In the 6+ years since, the family has received no other updates and are not aware of anyone being DNA tested. At the time the murder charge was dismissed, Wayland's family was told that the DNA was found on his pants leg. His family is still searching for justice today.
