On December 3, 2024, at approximately 7:45 p.m., Rayleen Mia Vasquez was driving east on NM 267 near Portales when Portillo's 2004 Chevrolet extended-cab pickup truck, traveling the wrong direction, collided head-on with her Nissan Kicks. Her vehicle was crushed in the impact, and she was pronounced dead at the scene. Portillo fled the scene on foot after the collision, carrying a bleeding toddler who was not restrained in the vehicle. Inside the truck, officers found a utility statement listing Portillo's residence half a mile west of the crash site, along with a Honduran passport that a witness confirmed accurately matched the man who fled. After an intensive search, New Mexico State Police arrested Portillo on December 4, 2024. He was booked into the Roosevelt Detention Center with a no-bond status.

At his first felony appearance on December 5, 2024, before Judge Christopher Mitchell, Portillo was released on a Personal Recognizance bond—meaning he was let go with only a promise to appear in court. 31-year-old Fredy Portillo was initially charged with leaving the scene of an accident, abuse of a child and driving without a license. District Attorney Quentin Ray said he has also now been charged with vehicular homicide. Investigators later determined that Portillo was driving without headlights and with an open container in his vehicle, prompting the amended charge. An Amended Criminal Complaint filed on December 6, 2024, increased charges to five counts. Portillo was indicted by a New Mexico Grand Jury on January 3, 2025. His bond was revoked on February 5, 2025, after authorities discovered his residence was vacant. According to his attorney, it is suspected he went to Mexico. Portillo had re-entered the U.S. after being deported from Texas in 2016. As of this posting, New Mexico’s court records database confirms there is no deposition in Portillo’s case and that he has not been re-arrested since the warrant was issued for his arrest.
